The complaint is that B of A encouraged debit card spending that would lead to overdraft and other fees.
One Sierra Vista, Arizona woman says she used a debit card to make a purchase.
But when the transaction was approved, it created an overdraft.
She says the fees went from $28 to $35. That caused a house payment to overdraft as well and she paid more fees.
Scott Hardy lists the class action suit and others on his website Topclassactions.com in Phoenix.
He says the $78 is not just handed to you.
You need to prove you were a victim.
In this case, you must have had a Bank of America debit card and paid a fee or charge for insufficient funds, overdrafts or returned items within 5 days of using an ATM or your debit card.
It had to happen between December of 2000 and December of 2007.
Bank of America will put $35 million into the settlement.
